TERMS AND CONDITIONS OF CARRIAGE
The following conditions apply to all persons, vehicles and goods transported by us. By travelling with us, you are agreeing to the following conditions:

Any reference to “we”, “our” or “us” is a reference to Sea Stradbroke Assets Pty Ltd A.C.N. 120 817 683 (also known as Stradbroke Getaways and Sea Stradbroke) (“the Company”) including where appropriate its employees, agents, independent contractors and sub-contractors. Any reference to “you” includes, without limitation, all passengers and persons entering into transactions with us. “Booking” means the booking entry made with and accepted by us in relation to travel sought by or on your behalf, the boarding pass, or any other document or message issued by us or on our behalf as part of or relating to your travel with us. All charges by the Company shall be our quoted prices listed in our published price list current at the date of the transaction. We may alter charges at any time without giving notice to you. You shall at all times follow and carry out all lawful directions of the Master and crew of the vessel, particularly in relation to (but not limited to) your personal safety or that of other passengers. You are required to be seated when advised or requested to do so by the Master, for any reason. Your vehicle must be securely parked and braked so as to prevent movement. If you fail to do this you will be responsible for any consequent damage your vehicle may cause. You must accept directions of the Master or crew during loading and unloading of the Vehicles You are required at all times to take all reasonable precautions for your own safety and the safety of any person in your care (particularly children). This includes but is not limited to using hand and guard rails at all times as provided around the vessel, appropriately restraining children and ensuring that children are accompanied by a responsible adult at all times. The Master or any other authorised person will refuse to take on board any vessel a person who in the Master's opinion may constitute a hazard either to the safety of the vessel or to the safety of the other persons on board that vessel or who in the Master's opinion may be a nuisance or annoyance to other passengers and may require a passenger to disembark the vessel at their sole discretion. We may decline to transport any person, vehicle or goods without giving any reason. We may cancel or vary scheduled trip without notice. All vehicles must have current vehicle registration to travel. We shall not be held responsible for any loss or damage (including personal injury) suffered by any person, as a result of breach of that person's safety obligations (as detailed in these conditions and/or as otherwise advised by the Master, or caused by any passenger acting in an unreasonable, unnecessary or unsafe manner. Full payment for the applicable charge must be paid at the time when your booking is confirmed. We are not liable to pay any refund on stolen, lost or destroyed tickets. You must arrive to board our Vessel at least 15 minutes prior to the scheduled departure time. The charges paid by you will be forfeited if you fail to board our Vessel before the scheduled departure time. We reserve our right to refuse boarding after this time. Subject to clause 12 below, no payment accepted by us is refundable under any circumstances to you. Up to 48 hours prior to travel: You may cancel and request a refund of the purchase price paid (less an administration fee of 10% of fare. You may reschedule the booking to another date within 6 months subject to the payment of any additional fare if applicable. If the booking is rescheduled more than once than an administration fee of $25.00 per booking will apply. All cargo is carried at owner's risk. Inflammable liquids may only be carried in containers approved by Australian Standards for this purpose. All cargo carried on board is to be accompanied by owners. All persons are carried at their own risk. Any typographical, clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by us shall be subject to correction without any liability on our part.
You MUST NOT
bring and consume, any alcoholic beverages on the vessel bring illegal substances onto the vessel. Subject to clause 17 below, we do not accept any liability for any claim whatsoever and howsoever incurred including but not limited to a claim for death, bodily injury, damage or loss of property (including vehicles) during embarkation and/or disembarkation to or from the vessel and/or at all times whilst onboard the vessel itself, or arising out of, or in any way connected to the provision of transport and other services to you (including claims for costs or losses resulting from cancellation of trips and or services, delay or rescheduling, substitution of means of transport, or any other change to the transport or services described in or covered by the booking), inaccuracies or errors in any information relation to transport, services or pricing. To the extent permitted by law, our liability for a breach of any provisions of the contract of carriage or related obligations shall not exceed a refund of the cost of the resupply by us of the service in question. Subject to clause 17 above, if you wish to make a claim against us in respect of our carriage of you, other passengers, your vehicle or goods, you must do so within two months of the date on which the carriage occurred. Smoking is prohibited anywhere on our Vessel. No oral representation concerning our liability which conflict with or detract from theses conditions will be binding. These conditions may be as varied by the Company from time to time without prior notice to customers. No agent, employee, independent contractor or sub-contractor of the Company is permitted to alter or vary these conditions in any way, Warranties implied in this contract by any legislation are included only to the extent that they must be included. Otherwise they are excluded. Your booking, the related contract and the carriage or other services supplied pursuant to it shall be governed by the laws for the time being in force in the State of Queensland. Incorrect declaration of vehicle measurements by you at the time of booking may lead to the vehicle not being loaded. Last Updated: 1st October 2007 |
